Burgan Lawyers recently helped a worker whose injury from 1998 worsened over time. The worker settled her case in 2000 and received lump sum compensation. To qualify for additional compensation for an old injury, two conditions must be met: the earlier compensation settlement must have been finalised before 19 June 2012 and there must be proof of worsening or additional impairment.

The Burgan Lawyers' team combed through nearly two decades of medical records to show the worker's injuries had worsened since 2000 and filed a claim for additional compensation. The insurer disputed the impairment assessment and Burgan Lawyers took the dispute to the Personal Injury Commission.

With thorough submissions and accurate medical-legal evidence, Burgan Lawyers established the worker's increased permanent impairment, resulting in the Commission awarding additional compensation.
